1. General provisions

1.1. Purpose of the Agreement

This User Agreement (the Agreement) sets out the terms for using JijiCat VPN (the Service) and governs the relationship between the Service Administration (the Administration) and the person using the Service (the User).

1.2. About the Service

JijiCat VPN provides secure VPN connections and related features available within the Service.

The Service is a continuously evolving digital product. Its functionality, interaction methods, plans and individual features may change as the project develops.

1.3. Acceptance of the Agreement

By starting to use the Service, the User confirms their acceptance of this Agreement.

Such acceptance is deemed confirmed if the User:

  • starts using the Service;
  • takes out a subscription;
  • tops up their account balance;
  • uses trial access;
  • redeems promo codes;
  • participates in the referral programme;
  • uses any other features of the Service.

If the User disagrees with any or all of the terms of this Agreement, they must stop using the Service.

1.4. Scope

This Agreement applies to all existing and future JijiCat VPN features unless the Administration establishes special terms for particular services or features.

2. Using the Service

2.1. General terms

The Service is provided for use in accordance with its intended purpose, this Agreement, the Service Rules and applicable law.

The User independently decides whether to use the Service and is responsible for complying with the laws of the country in which they use it.

2.2. Account

An account, User identifiers or other means of access provided by the Service may be used to access certain features.

The User is responsible for safeguarding their authentication credentials and taking reasonable measures to prevent third-party access to their account.

All actions performed using the User’s account or other access credentials before the Administration is notified of their possible compromise are deemed to have been performed by the User.

2.3. Acceptable use

The User undertakes to use the Service in good faith and to refrain from actions that could disrupt it or harm the Administration, other Users or third parties.

In particular, the Service must not be used:

  • for unlawful activities;
  • to infringe the rights and legitimate interests of third parties;
  • to distribute malware;
  • to attack information systems;
  • to obtain advantages by circumventing restrictions or abusing the Service’s features;
  • in a manner that places an excessive load on the Service infrastructure or prevents other Users from using it.

Using the Service does not exempt the User from responsibility for their actions on the internet.

3. Subscription, payment and account balance

3.1. Subscription

Access to certain features of the Service is provided on a Subscription basis.

Prices, validity periods, plan contents and available payment methods are determined by the Administration and published in the Service.

Changes to Subscription prices or terms apply only to future transactions and do not affect periods already paid for.

3.2. Automatic renewal

The Service may offer automatic Subscription renewal.

The User can manage its settings using the tools provided by the Service.

Automatic renewal is managed using the tools provided by the Service.

3.3. Account balance

An account balance may be used to pay for the Service.

The account balance is intended solely for use within JijiCat VPN and is not a bank account, electronic money or an independent payment instrument.

Unless the Administration expressly provides otherwise, account balance funds and bonus credits cannot be withdrawn, exchanged for money or transferred to other Users.

3.4. Technical errors

If a technical error causes incorrect display of service prices, credits, the account balance, bonuses or other data, the Administration may remedy its consequences, including adjusting transactions resulting from that error.

4. Loyalty programmes

The Administration may offer Users additional benefits, including trial access, promo codes, bonus credits, a referral programme, promotions and other loyalty programmes.

The Administration independently determines the terms of each programme, which may change as the Service develops.

Unless the terms of a particular programme expressly provide otherwise, bonuses, discounts and other benefits are solely for use within the Service and cannot be exchanged for money, withdrawn or transferred to other Users.

If abuse, circumvention of rules, creation of multiple accounts to obtain benefits or other bad-faith conduct is identified, the Administration may refuse benefits, cancel credits, adjust the account balance or end the User’s participation in the relevant programme.

5. Rights and obligations of the parties

5.1. User rights

The User may:

  • use the Service in accordance with this Agreement;
  • access Service features within the scope of their purchased subscription;
  • contact support about using the Service;
  • participate in loyalty programmes subject to their terms.

5.2. User obligations

The User must:

  • comply with this Agreement, the Service Rules and applicable law;
  • use the Service in good faith and for its intended purpose;
  • refrain from actions that could disrupt the Service or harm the Administration, other Users or third parties;
  • ensure that their own devices, software and internet connection function properly.

5.3. Administration

To ensure stable, secure and high-quality operation of the Service, the Administration may:

  • develop the Service and change its functionality, interface, interaction methods, plans and other terms of use;
  • carry out technical, preventive and emergency work;
  • temporarily restrict access to certain Service features during such work;
  • remedy the consequences of technical errors;
  • delete or archive unused User accounts or other means of access;
  • review User requests and make decisions on them;
  • take other measures necessary for the normal operation and development of the Service.

6. Restriction and termination of access

6.1. The Administration may temporarily restrict or terminate the User’s access to the Service if there are sufficient grounds to believe that the User:

  • violates this Agreement;
  • violates the Service Rules;
  • violates applicable law;
  • uses the Service in a way that threatens its stable operation, security or other Users;
  • abuses the Service’s features or loyalty programmes.

6.2. If circumstances require further investigation, access to certain Service features may be temporarily restricted until the situation has been reviewed.

6.3. Termination of access does not release the User from obligations that arose before termination.

7. Refunds

7.1. The Administration strives to provide services of appropriate quality and to resolve issues in good faith.

7.2. Services may be paid for by topping up the account balance, paying for a Subscription or another method provided by the Service. Unless otherwise stated in the Service or the terms of a particular programme, funds are credited to the account balance and/or access to a paid Subscription is provided within 3 calendar days of payment, provided the Service receives the information required to identify that payment.

7.3. If funds have been debited but not credited to the account balance and/or access to the paid Subscription has not been provided within the period specified in clause 7.2, the User may submit a payment review and refund request within 7 calendar days after that period expires.

7.4. Payment review and refund requests must be submitted through the official JijiCat VPN contact methods published on the Service’s official resources. The request should preferably include:

  • the account identifier, username or another available User identifier;
  • the payment date and amount;
  • the payment purpose: account balance top-up, Subscription payment or another transaction provided by the Service;
  • the selected plan and Subscription period, if the payment was for a Subscription;
  • the payment transaction identifier, order number, receipt, payment screenshot or other proof of payment, if available to the User;
  • a description of the situation.

7.5. The Administration reviews the request within 5 business days of receiving all information necessary for the review. If additional information is needed, the Administration may request it from the User.

7.6. If the review confirms that funds were debited but not credited to the account balance and/or access to the paid Subscription was not provided for reasons attributable to the Administration or the payment and technical mechanisms used by the Service, the relevant payment will be refunded in full.

7.7. If the request is approved, the refund is initiated no later than 10 calendar days after receipt of a duly completed request, unless a different period is required by applicable law or the relevant payment provider’s rules.

7.8. Refunds are made using the same method and to the same account details or payment instrument used for payment, unless otherwise required by the payment provider, bank, payment system or applicable law. The time for funds to arrive may depend on the bank, payment system or other payment provider.

7.9. Refund requests on other grounds are reviewed individually, taking into account the circumstances, applicable law, this Agreement, the nature of the issue, whether it can be resolved, its duration and the extent of services actually provided.

7.10. Problems caused by the User’s actions, their device settings, the software they use, actions of internet providers, restrictions imposed by public authorities or other circumstances beyond the Administration’s control do not in themselves constitute an unconditional basis for a refund.

7.11. If access is terminated because the User violated this Agreement or the Service Rules, payments are generally non-refundable unless otherwise required by applicable law or decided by the Administration at its discretion.

7.12. Bonuses, discounts, promo codes, trial access and other loyalty programme benefits cannot be exchanged for money, withdrawn or refunded in monetary form unless the relevant programme expressly provides otherwise.

8. Liability

8.1. The Administration strives to ensure stable and secure operation but cannot guarantee uninterrupted service or the absence of technical errors.

8.2. The Service may depend on factors beyond the Administration’s control, including:

  • internet connection quality;
  • the User’s hardware and software;
  • actions of internet providers;
  • restrictions in the country where the Service is used;
  • other objective circumstances beyond the Administration’s control.

8.3. Use of the Service does not in itself guarantee access to any particular online resource, service or information system.

8.4. The Administration is not liable for inability to use the Service caused by circumstances it could not reasonably foresee or prevent.

8.5. The User independently decides whether to use the Service and is responsible for complying with the laws of the country where it is used.

8.6. Neither party is liable for indirect losses, lost profits or other consequences of using or being unable to use the Service, unless otherwise required by applicable law.

9. Intellectual property

9.1. Exclusive rights to the Service, including its software, design, graphics, text, interface elements, databases, logos, brand identifiers and other intellectual property, belong to the Administration or are used by it lawfully.

9.2. Use of the Service does not transfer any exclusive or other intellectual property rights to the User.

9.3. Copying, distributing, modifying, decompiling, reverse engineering or otherwise using intellectual property is permitted only where allowed by law or with prior permission from the rights holder.

10. Privacy

10.1. Processing of User data is governed by the JijiCat VPN Privacy Policy.

10.2. The Privacy Policy is an integral part of this Agreement.

10.3. By using the Service, the User confirms that they have read and agree to the Privacy Policy.

11. Changes to the Agreement

11.1. The Administration may amend this Agreement at any time.

11.2. A new version takes effect upon publication unless it specifies a different effective date.

11.3. Continued use of the Service after publication of a new version constitutes acceptance of the changes.

12. Final provisions

12.1. This Agreement takes effect when use of the Service begins and applies throughout its use.

12.2. If any provision is found wholly or partly invalid or unenforceable, the remaining provisions remain valid.

12.3. Matters not covered by this Agreement are governed by applicable law.

12.4. The Service Rules and Privacy Policy are interrelated documents governing the use of JijiCat VPN. If this Agreement conflicts with the Service Rules, this Agreement prevails.

12.5. For questions about the Service, the User may contact support through the official JijiCat VPN communication channels published on its official resources.
